Judicial Trends and Constitutional Pathways: Advancing Gender Justice in India
Abstract
Gender justice is a fundamental human right, essential for achieving equality, development, and peace. Despite progress in various spheres, gender inequality remains a pervasive issue in India, perpetuating discrimination, violence, and exclusion. This research paper examines the constitutional perspectives on gender justice in India, analyzing the provisions, landmark judgments, and the way forward to achieve true gender equality. The paper highlights the challenges and gaps that persist, including gender-based violence, discrimination, and exclusion, and emphasizes the need for a collaborative approach to address these issues. The paper concludes with recommendations to strengthen legal frameworks, promote awareness and education, increase women's representation, support economic empowerment, and enhance access to justice and support services.
